REQUEST FILED URGING CALIFORNIA BOARD OF PAROLE HEARINGS TO RECONSIDER PAROLE GRANT TO DAVID FUNSTON

Sacramento, CA — Today, the Criminal Justice Legal Foundation and the California District Attorney’s Association made a formal request to the California Board of Parole Hearings urging reconsideration and possible rescission of its recent decision granting parole to David Funston. The request cites the seriousness of Funston’s crimes, public safety concerns, and the Board’s regulatory authority to revisit parole grants prior to an inmate’s release.

The letter calls on the Board to exercise its authority under California Code of Regulations, Title 15, sections 2450–2471, which allow postponement or rescission of a parole date when circumstances indicate parole may have been improvidently granted or when new or previously underappreciated information raises public safety concerns. The request also references established California case law confirming the Board’s inherent authority to reconsider parole decisions before release occurs.

“This case involves extremely serious criminal conduct with lasting impact on victims and the community,” the letter states. “Before any release proceeds, it is essential that all public safety considerations, victim impact factors, and risk assessments be fully and carefully evaluated.”
